These Driver Terms & Conditions (“Terms”) govern your relationship with The Van Man Co and your use of our platform as an independent driver (“Driver”, “you”, “your”).

By registering as a Driver, maintaining a Driver profile, accepting bookings, or carrying out services arranged via our platform, you confirm that you have read, understood, and agree to be bound by these Terms.


1. Definitions

In these Terms:

  • “Platform” means the website, booking system, calculator, dashboards, software, and related services operated by The Van Man Co.

  • “Customer” means any individual or business that books or requests services via the Platform.

  • “Service” means any transport, removals, delivery, or related work performed by you for a Customer.

  • “Booking” means a confirmed service request accepted by a Driver.

  • “Driver Profile” means the information, images, pricing, and availability you provide to be displayed on the Platform.


2. Independent Contractor Status

2.1 No Employment Relationship

You acknowledge and agree that:

  • You are an independent contractor, not an employee, worker, agent, partner, or representative of The Van Man Co.

  • Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship.

  • You operate your own business and provide services in your own name.

2.2 Platform Role

The Van Man Co acts solely as a booking and introduction platform. We:

  • Introduce Customers to independent Drivers.

  • Facilitate quotes, deposits, and booking administration.

We do not:

  • Control how you perform services.

  • Supervise, manage, or direct your work.

  • Accept responsibility for service performance, conduct, or outcomes.


3. Driver Eligibility & Registration

To register and remain active as a Driver, you must:

  • Be at least 18 years old.

  • Hold a valid driving licence suitable for your vehicle.

  • Maintain all legally required insurance (see Section 4).

  • Provide accurate, truthful, and up-to-date information at all times.

  • Ensure your vehicle is roadworthy, safe, and fit for commercial use.

We reserve the right to suspend or remove any Driver who fails to meet these requirements or provides misleading information.


4. Insurance, Liability & Responsibility

4.1 Insurance Obligations

You are solely responsible for maintaining appropriate insurance, including but not limited to:

  • Commercial motor insurance.

  • Goods-in-transit insurance.

  • Public liability insurance (where applicable).

You must ensure your insurance remains valid at all times while operating through the Platform.

4.2 Liability for Damage & Injury

You acknowledge and agree that:

  • You are fully liable for any loss, damage, or breakage to items occurring during a Service.

  • You are responsible for any injury caused to:

    • Yourself,

    • Customers,

    • Third parties,
      resulting from unsafe working practices, negligence, or failure to follow reasonable safety standards.

  • The Van Man Co accepts no liability for damage, injury, or loss arising from your actions or omissions.

4.3 Indemnity

You agree to fully indemnify and hold harmless The Van Man Co against all claims, losses, damages, costs, liabilities, or expenses arising from:

  • Your provision of Services,

  • Damage to property or goods,

  • Personal injury or death,

  • Breach of these Terms,

  • Breach of any law or regulation.


5. Bookings & Service Performance

5.1 Acceptance of Bookings

A Booking is only confirmed when:

  • The Customer submits a valid booking request, and

  • You accept the Booking via the Platform or agreed communication method.

Once accepted, you are expected to complete the Booking as agreed.

5.2 Completion of Jobs

You agree to:

  • Attend on time and prepared.

  • Complete the job fully unless prevented by factors outside your reasonable control.

  • Act in good faith to resolve issues that arise during a job.

Failure to complete accepted Bookings may result in removal from the Platform.


6. Payments, Fees & Commission

6.1 Platform Commission

The Van Man Co currently charges a 20% commission on the total value of each Booking.

You acknowledge that:

  • This commission may be taken as a deposit or service fee.

  • We reserve the right to amend the commission rate at any time, with reasonable notice provided via the Platform or email.

6.2 Driver Payments

  • Any remaining balance is paid directly to you by the Customer unless otherwise stated.

  • You are solely responsible for declaring and paying any taxes due on income received.

6.3 Pricing & Estimates

Quotes provided via the Platform are estimates only and may change based on:

  • Actual time taken,

  • Access issues,

  • Additional stops,

  • Changes to Customer requirements.


7. Driver Standards & Customer Etiquette

You are expected to uphold high professional standards at all times.

7.1 Professional Conduct

You must:

  • Act politely, respectfully, and professionally toward Customers.

  • Avoid aggressive, abusive, discriminatory, or inappropriate behaviour.

  • Communicate clearly and calmly, even when issues arise.

7.2 Flexibility & Customer Care

You agree to:

  • Show reasonable grace and flexibility where Customers’ needs change during a job.

  • Make genuine efforts to accommodate minor adjustments where practical.

  • Work toward completing jobs to the Customer’s reasonable satisfaction.

7.3 Safety & Care

You must:

  • Use safe lifting and handling practices.

  • Protect Customer property to a reasonable professional standard.

  • Refuse unsafe requests politely and explain your reasoning clearly.


8. Reviews, Complaints & Platform Action

Customers may leave reviews or raise complaints.

We reserve the right to:

  • Investigate complaints,

  • Restrict visibility of your profile,

  • Suspend or permanently remove you from the Platform.

Repeated poor feedback, unsafe conduct, or failure to meet standards may result in immediate removal.


9. Data Protection & Confidentiality

You must:

  • Use Customer data only for completing the Service.

  • Not store, misuse, or share Customer data unlawfully.

  • Comply with applicable data protection laws.


10. Changes to These Terms

We may update these Terms from time to time.
Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.


11. Governing Law

These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
